Employers must have a signed release form before they can make inquiries into criminal records.

Employers can ask about arrests that did not result in conviction. Employers may only consider criminal history if it bears on the applicant’s trustworthiness or the safety or well-being of the employer’s employees or customers.

Occupational licensing authorities may refuse to grant license to anyone with a criminal record regardless of their qualifications.
