New Jersey General Guidelines
N.J. Admin. Code tit. 13, ยงยง 591.2, 591.6
Employers may obtain criminal record information about convictions and about any pending arrests or charges in order to determine qualifications for position or job. Pre-adverse notification must be provided to applicant when requesting record and sufficient time must be provided for applicant to challenge, correct or complete record. Employer should not presume guilt for any pending charges or court actions.
Occupational licensing agencies may not automatically bar someone from licensure based on convictions or disorderly person adjudication unless the conviction or adjudication disqualifies the individual from public office or relates adversely to the license sought.
